TERMS OF USE FREE TRIAL VERSION OF THEFRONTBEST 
       

KaizenHotels SRL, in the person of its pro tempore legal representative, VAT number 12034310966, with registered office in Milan, Viale Luigi Majno, 28, 20129 Milan (Italy), PEC: kaizenhotels@pec.it, (hereinafter KaizenHotels), exclusive owner of TheFrontBest software (http://www.thefrontbest.com) hereby regulates the terms and conditions of use of the free trial software that the User has requested by clicking on the appropriate trial button  and by filling out the contact form. 

KaizenHotels will provide the User who has requested it with a temporary ID and Password to be able to access the trial version of the software exclusively in SaaS (software a service) mode. By filling out the free trial request, the User declares that he/she has read, understood and accepted these license conditions.

1. Subject matter of the contract

The purpose of this agreement is to grant a free and temporary license to use the TheFrontBest software in a free trial version to examine the features of the product and evaluate its purchase. 

2. Proprietary Rights

All intellectual property rights are the exclusive property of KaizenHotels and the license to use it does not constitute an assignment or sale of the ownership rights relating to the platform itself or to individual parts of it.

The contents of TheFrontBest are the subject of intellectual and industrial property belonging to KaizenHotels and the Client may not in any case modify, alter, rework or create derivative applications. Furthermore, the contents of TheFrontBest are protected by the laws in force in civil and criminal matters. 

3. Duration

Unless otherwise agreed between the parties, this license will have a duration of 15 (fifteen) days starting from the communication of the access credentials by KaizenHotels, unless otherwise agreed between the Parties.

4. User Obligations

The User undertakes not to use the service for illegal purposes or against public order, morality and morality or for illicit purposes; not to use the service to transmit and/or disseminate illicit, pornographic, racist, privacy-infringing and/or otherwise obscene, vulgar, defamatory, abusive material; not to transmit material and/or messages that encourage third parties to engage in illegal and/or criminal conduct punishable by civil and/or criminal liability; ensure that end users and/or any persons using the service comply with all regulations, directives and network procedures related to the service itself; not to manipulate distinctive signs or indications in order to disguise the origin of a content of the service or the service itself; not to use or disseminate the content of the service that infringes patents, trademarks, secrets, copyrights or other industrial and/or intellectual property rights of KaizenHotels or third parties.

5. Disclaimer

Except for wilful misconduct or gross negligence, KaizenHotels shall not be held liable for any loss of profit, loss of profit or indirect damage, loss or damage to data, business downtime, loss of business opportunities or other benefits, payment of penalties, delays or other liabilities deriving directly and/or indirectly to the User from the use of TheFrontBest software.

6. Termination of Service

At the end of the trial period, KaizenHotels will automatically cease to provide the service and all data, documents and/or content uploaded will be permanently deleted without the possibility of recovery. 

7. Privacy Policy

The User's personal data collected  and processed by KaizenHotels for its own purposes and methods and for the processing of which, therefore, KaizenHotels is the Data Controller pursuant to the GDPR will be processed in accordance with the information provided by KaizenHotels pursuant to Article 13 of the GDPR and can be consulted at any time on the website http://www.thefrontbest.com
